Effective Date: November 1, 2025

1) Purpose & Parties

WealthPath Agent Academy™ (“WPAA,” “we,” “us”) is an educational program owned by Nielsen Executive Services, Inc. Enrollment grants the student (“you,” “Student”) limited, personal, non-transferable access to proprietary training and resources.

2) Intellectual Property

All WPAA content—videos, worksheets, templates, scripts, frameworks, brand assets, process maps, and written materials—is the exclusive property of Nielsen Executive Services, Inc. You may use these materials to operate and improve your own real estate business; you may not copy, share, publish, distribute, train others with, or create derivatives from WPAA content without prior written permission.

3) Enrollment & Access

Enrollment provides personal, device-agnostic access for the single Student who purchased access. Login sharing, sublicensing, or team use is not permitted unless separately licensed under a Team Access agreement.

4) Payment & Refunds

All payments are final and non-refundable. Access to proprietary materials is granted upon purchase; for that reason, we do not offer refunds or partial credits.

5) Confidentiality

You agree to keep WPAA materials, community discussions, and non-public program information confidential and to use them only for your own business operations.

6) Disclaimer (No Legal/Tax/Financial Advice; No Earning Guarantees)

WPAA provides education and strategy, not legal, tax, compliance, lending, or financial advice. Results depend on your market, effort, and implementation. No outcomes or earnings are promised or guaranteed.

7) Compliance Is Your Responsibility

You are solely responsible for complying with all federal, state, and local laws, real estate license rules, MLS/association policies, advertising regulations, fair housing rules, and any partner terms that apply in your market.

8) Indemnification

You agree to defend, indemnify, and hold harmless WPAA and Nielsen Executive Services, Inc., and our officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of WPAA materials, your non-compliance with applicable laws or license rules, or your breach of these Terms.

9) Limitation of Liability

To the maximum extent permitted by law, WPAA/Nielsen Executive Services, Inc. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. Our total aggregate liability for any claim arising out of these Terms or your use of WPAA will not exceed the amount you paid for the most recent twelve (12) months of program access.

10) Modifications

We may update these Terms to reflect new modules, features, or compliance standards. The “Effective Date” above will be revised when changes are posted. Your continued use after updates constitutes acceptance.

11) Privacy Policy

A. What We Collect

We collect only what we need to operate WPAA and communicate with you:

Identifiers/Contact: name, email, phone, business details, billing address.
Transaction Data: purchase amount, product, date (payment details are processed by a third-party processor; we do not store full card numbers).
Usage/Device Data: IP address, browser type, pages viewed, timestamps.
Campaign/Attribution Data: UTM parameters, ad interactions, referral source.
Media Embeds & Pixels: We use analytics and marketing tools (e.g., Google Analytics, Meta Pixel) and may embed third-party media (e.g., YouTube/Vimeo). These third parties may place cookies or use similar tech consistent with their own policies.

B. How We Use Data

Provide and manage course access and customer support.
Process payments and send purchase confirmations.
Send program updates, operational notices, and service emails.
Improve content, performance, and fraud/security monitoring.
Run analytics and ad measurement/retargeting (where permitted).

C. Disclosures/Service Providers

We share data with service providers who help us operate (e.g., site hosting, email delivery, analytics, payment processing such as PayPal/Stripe/Square). We do not sell your personal information.

D. Cookies & Tracking

We use cookies, pixels, and similar technologies for site functionality, analytics, and advertising measurement. You can manage cookies in your browser. Ad platform settings (e.g., Google/Meta) let you control personalized ads.

E. Your Rights

Subject to applicable law (e.g., GDPR/UK GDPR, CPRA/VA/CO/CT/UT privacy laws), you may request to access, correct, or delete your personal information, and opt out of targeted advertising or profiling to the extent those laws apply. F. Security & Retention

We use administrative, technical, and organizational safeguards appropriate to our size and data types. No system is perfectly secure. We retain personal information only as long as necessary for the purposes described, to comply with legal obligations, resolve disputes, and enforce our agreements.

G. Children

WPAA is not directed to children under 13 (or 16 where applicable). We do not knowingly collect data from children.

H. International Transfers

If you access WPAA from outside the U.S., your data may be processed in the U.S. By using WPAA, you consent to that transfer.

Governing Law; Venue; Severability

These Website Terms are governed by Florida law (without regard to conflict-of-law rules). Exclusive venue lies in the state or federal courts located in Sarasota County, Florida, and you consent to personal jurisdiction there. If any provision is held invalid, the remainder will continue in effect.

Class Action Waiver
